1. Acceptance of Terms
By accessing our website or engaging ADS Infra by Yadav Group’s services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
2. Services Offered
ADS Infra provides:
- Construction services (Infrahip)
- Architectural design services
- Furniture work and interior design
- Renovation services
All services are subject to availability and our professional assessment.
3. Project Quotations and Estimates
3.1 All quotations are valid for 30 days from the date of issue.
3.2 Estimates are approximate and may vary based on:
- Material price fluctuations
- Site conditions
- Design changes
- Regulatory requirements
3.3 Final costs will be confirmed in the project agreement.
4. Project Agreement
4.1 A detailed project agreement will be executed before commencement of work.
4.2 The agreement will specify:
- Scope of work
- Timeline
- Payment schedule
- Materials to be used
- Terms and conditions
4.3 Both parties must sign the agreement for it to be valid.
5. Payment Terms
5.1 Payment schedule will be as follows (unless otherwise specified):
- 20% advance payment on agreement signing
- 30% on completion of foundation/structural work
- 30% on completion of 70% of work
- 15% on completion of finishing work
- 5% on final handover
5.2 Payments must be made as per schedule to avoid project delays.
5.3 Delayed payments may attract interest charges of 2% per month.
5.4 All payments should be made via bank transfer, check, or online payment to company accounts only.
6. Project Timeline
6.1 Timelines provided are estimates based on normal working conditions.
6.2 Delays may occur due to:
- Weather conditions
- Material shortage
- Labor issues
- Client-requested changes
- Government regulations
- Force majeure events
6.3 We will make reasonable efforts to minimize delays and keep clients informed.
7. Changes and Modifications
7.1 Any changes to the approved design or scope of work must be requested in writing.
7.2 Changes may affect:
- Project cost
- Timeline
- Material requirements
7.3 A revised quotation will be provided for approval before implementing changes.
7.4 Change orders must be approved by both parties.
8. Materials and Quality
8.1 We use quality materials from reputed manufacturers.
8.2 Specific brands will be mentioned in the project agreement.
8.3 Material substitutions may occur due to availability but will be of equivalent or better quality.
8.4 Client-provided materials must meet our quality standards.
9. Site Access and Conditions
9.1 Client must provide:
- Unobstructed site access
- Electricity and water connection
- Secure storage area for materials
- Necessary permits and approvals
9.2 Any site condition issues must be disclosed before agreement signing.
10. Client Responsibilities
10.1 Provide timely decisions and approvals
10.2 Make payments as per schedule
10.3 Obtain necessary permissions from authorities
10.4 Inform neighbors about construction activity
10.5 Provide accurate site information
11. Warranty
11.1 We provide the following warranties:
- Structural work: 5 years
- Finishing work: 1 year
- Furniture: 1 year (excluding normal wear and tear)
11.2 Warranty covers manufacturing and installation defects only.
11.3 Warranty does not cover:
- Damage due to misuse
- Natural disasters
- Unauthorized modifications
- Normal wear and tear
12. Liability Limitations
12.1 Our liability is limited to the project value.
12.2 We are not liable for:
- Delays beyond our control
- Third-party claims
- Consequential damages
- Acts of God
13. Project Cancellation
13.1 Client may cancel the project with written notice.
13.2 Cancellation charges:
- Before work starts: 10% of project value
- After work starts: Cost of work done + 20% cancellation fee
13.3 Advance payment is non-refundable after work commencement.
14. Dispute Resolution
14.1 Any disputes will first be attempted to be resolved through mutual discussion.
14.2 If unresolved, disputes will be subject to arbitration in Indore, Madhya Pradesh.
14.3 The courts of Indore will have exclusive jurisdiction.
15. Intellectual Property
15.1 All architectural designs, drawings, and plans remain our intellectual property.
15.2 Designs are licensed for single-use only and cannot be reproduced without written permission.
16. Photography and Marketing
16.1 We reserve the right to photograph completed projects for marketing purposes.
16.2 Clients may request privacy, which will be respected.
17. Force Majeure
We are not liable for delays or non-performance due to circumstances beyond our control, including natural disasters, strikes, government actions, or pandemics.
18. Safety and Regulations
18.1 We comply with all applicable building codes and safety regulations.
18.2 We maintain worksite safety as per industry standards.
18.3 Clients and visitors must follow safety guidelines when visiting the site.
19. Subcontractors
We reserve the right to engage subcontractors and specialists as needed. All subcontractors will meet our quality standards.
20. Confidentiality
We maintain confidentiality of client information and project details.
21. Service Area
Our services are available in Indore, Ujjain, Mhow, Dewas, and Bhopal. Projects outside these areas are subject to additional charges and availability.
22. Amendments
We reserve the right to modify these Terms and Conditions. Updated terms will be posted on our website.
23. Severability
If any provision of these terms is found invalid, the remaining provisions will continue in full force.
24. Entire Agreement
The project agreement, along with these Terms and Conditions, constitutes the entire agreement between parties.
